1. Introduction

The Terms and Conditions page explains the conditions of use of the Caritas Mauritius website. When you use Caritas Mauritius, you automatically accept all the rules detailed on this page. By using this website (the “Site”) and the services (“Services”) offered by Caritas Mauritius (as well as by, its agents, representatives, consultants, employees, directors, the Board of Directors, Administrators and Members), you agree to these legally binding rules (the “Terms”). You also agree to our privacy policy and agree to follow any other rules on the site.

These conditions may change without notice. However, we will inform you of any important changes, either by informing you on the site or by sending you an email. The new versions of the terms will never apply retroactively – we will tell you the exact date on which they will come into effect. If you continue to use the site after the announcement of a change, it automatically means that you agree to the new terms.

2. Create an account

To create an account, you must be 18 years of age or older. You are responsible for your account and all activity on it.

You can browse the site without registering for an account. However, to use some of the features of the site, you must register, choose an account name and set a password. When you do this, the information you provide us must be accurate and complete. Do not pretend to be someone else and do not choose names that might be offensive or that could violate anyone’s rights. If you do not follow these rules, we may cancel your account with immediate effect.

You are responsible for all activities in your account and the confidentiality of your password. If you discover that someone has used your account without your permission, you must notify us immediately.

3. Funding by donors

You will have the right to provide funds for various projects proposed by Caritas Mauritius (national and international). The details of the projects will be posted on the site. The financing of the various projects can be done by means of an online payment gateway, the MCB Juice service, a bank transfer or by check, but also by other means of payment (SMS, etc.) and can be done in any currency. Caritas Mauritius reserves the right, in its sole discretion, to authorize this financing by check, as a last resort and not by online payment.

4. Other websites

If you follow a link to another website, you are responsible for what is happening between you and them – not us.
The site may contain links to other websites, Caritas Mauritius can not be held responsible for the content and services of external sites Caritas Mauritius.

5. Intellectual property of Caritas Mauritius

The content of the site is protected in different ways. You have the right to use it for personal purposes, but you can not use it for commercial purposes without the prior permission of Caritas Mauritius.

Services are legally protected in a variety of ways, including copyrights, trademarks, service marks, and other rights and laws. You agree to respect all copyrights and other legal notices, information and restrictions contained in any content accessible through the site. You also agree not to modify, translate or create in any way any derivative works of the Service.

If you wish to use, reproduce, modify, distribute or store any content relating to the Site and / or the Services for commercial or other purposes, you must obtain the prior written permission of Caritas Mauritius or the copyright holder concerned. A “business purpose” means that you intend to use, sell, license, rent, or otherwise exploit the Content for any commercial purpose, in any manner whatsoever.

6. Deleting your account

You can delete your account at any time. Deleting your account will not delete the content you have already posted.
You can cancel your account at any time. All the provisions of this agreement occur upon the termination of an account, including our rights to any content that you have already submitted to the site. (For example, if you submitted a testimonial, deleting your account will not remove it from the site.)
7. Our rights
To work, we must be able to keep control of what is happening on the site. So in this section we reserve the right to make decisions to protect the integrity of our system. We do not take these powers lightly and only use them when we absolutely have to.

Caritas Mauritius reserves the right to:
• Make changes to the site and services without notice or liability.
• Decide who is eligible to use the site. We may cancel accounts or refuse to offer our services.
• Caritas Mauritius is not liable for damages resulting from these actions and it is our policy not to comment on the reasons for such action.

8. Release of guarantee

We work diligently to provide you with excellent services, but we can not guarantee that everything will always work perfectly. This site is presented as is, without guarantee.
You use our services only at your own risk. They are provided “as is” and “as available” and without warranty of any kind, express or implied.

Caritas Mauritius expressly disclaims all warranties and conditions of merchantability, non-infringement and fitness for a particular purpose, as well as any warranties implied by a process, performance or use of the trade. No advice or information (oral or written) obtained by you from Caritas Mauritius can not constitute a guarantee.

9. Limitation of liability

Caritas Mauritius is not liable for damages or losses related to your use of the Services. We are not involved in disputes between users, or between users and third parties, related to the use of the Services.
If something detrimental happens as a result of your use of the site, we will not be liable.
To the fullest extent permitted by law, Caritas Mauritius, its directors, employees, partners, suppliers or content providers shall under no circumstances be held liable for any damages whatsoever, direct, indirect, incidental, punitive, consequential, special or exemplary, including, but not limited to, damages (i) resulting from your access, use or inability to access or use the Services; (ii) for any shortfall, loss of data, cost of purchase or replacement of goods or services; or (iii) for any content of a third party’s content on the site.

10. Data protection

Caritas Mauritius hereby agrees to comply with all applicable provisions of the Data Protection Act 2004 when processing your personal information for the purposes of the site and any other related activities.
Where applicable, all project promoters are required to comply with all applicable provisions of the 2004 Data Protection Act.

11. Dispute Resolution and Applicable Law

We are located in the Republic of Mauritius and any dispute with us must be treated in the Republic of Mauritius in accordance with Mauritian law in force.
Caritas Mauritius encourages you to contact us if you encounter a problem before going to court. In the unfortunate event that a lawsuit occurs, these Terms (and any other rules, policies or guidelines incorporated by reference) will be governed by and construed in accordance with Mauritian law and without giving effect to principles of conflict of laws. You agree that Caritas Mauritius and its services are considered to be a passive site that does not give Caritas Mauritius, its affiliated centers, employees, agents, agents, officers, the board of directors, directors, sub-committees and their members, specific or general, in any jurisdiction other than Mauritius. You agree that any action in law or equity arising out of or in connection with these Terms, your use or the non-use of the Site, shall be filed only in the Republic of Mauritius, and you consent to and submit to the jurisdiction of these courts to advocate such action.

12. Miscellaneous

These Terms and the other documents referenced herein constitute the entire agreement between you and Caritas Mauritius with respect to the Services. They replace all other communications and proposals (verbal, written or electronic) between you and Caritas Mauritius regarding services and govern our future relations. If any provision of these Terms is held to be invalid by law, that provision will be limited or removed to the minimum extent necessary for the Terms to remain otherwise in effect and enforceable. If you or Caritas Mauritius does not exercise the right provided for in these Terms and Conditions in any way, this will not be considered a waiver of other rights.
These conditions are personal to you. You may not assign, transfer or sublicense them unless you have Caritas Mauritius’ prior written consent. Caritas Mauritius has the right to assign, transfer or delegate any of its rights and obligations under these Terms without your consent. Caritas Mauritius will notify you by email, in writing or by posting the message on our site.
